Information provided pursuant to articles. 13 and 14 of Regulation (EU) 2016/679 (General Data Protection Regulation).

 

This page describes the management methods of the site https://sistenzamilanese.segnalazioni.net (hereinafter "Platform") in relation to the processing of personal data of users who consult it. The information is provided only for this site and not also for the Institutional site. The conditions set out below are likely to be modified over time and, consequently, updated at any time.

 

The data provided at the time of registration and/or in the content of the reports will be processed according to the principles of correctness, lawfulness, transparency and protection of the confidentiality and rights of all interested parties, in compliance with the confidentiality obligations imposed by the legislation on processing of personal data and provided for by Legislative Decree no. 24/2023 regarding whistleblowing.

 

We remind you that registration on the Platform, with the consequent release of the reporting person's personal data, is not mandatory; it is in fact possible to make an anonymous report (in this case there will be no processing of personal data).

 

CATEGORIES OF PERSONAL DATA PROCESSED AND PURPOSES OF THE PROCESSING

The Platform will process personal data concerning you, in particular name, surname, e-mail address; such data may be provided directly by you during registration and/or taken from your reports.

 

Your personal data will be processed: (i) to allow you to register and access the platform (where you decide to use the reporting method with registration); (ii) to fulfill legal obligations, including the execution of the obligations required by Directive (EU) 2019/1937 (Legislative Decree 24/2023 Italian legislation; Ley 2/2023 Spanish legislation) regarding Whistleblowing, in cases and within the terms established by the same legislation.

We also inform you that the personal data relating to the profile cannot be directly viewed in the report.

 

LEGAL BASIS OF DATA PROCESSING

With reference to the purposes referred to in point (i) the legal basis that legitimizes the processing is constituted by your consent, expressed by clicking on the appropriate button after having read this information; this consent is necessary and failure to provide it results in the impossibility of making a "report with registration". However, we remind you that it is possible to make an anonymous report and that in this case there will be no processing of personal data, with the exception of any personal data entered by you in the report.

 

With reference instead to the purposes referred to in point (ii) the legal bases that legitimize the processing are constituted by the legitimate interest of the data controllers and the fulfillment of legal obligations.

 

DATA PROCESSING AND STORAGE METHODS

The processing of personal data will be carried out with IT and telematic tools with organization and processing logic strictly related to the purposes indicated above and in any case in such a way as to guarantee the security, integrity and confidentiality of the data themselves in compliance with the organisational, physical and logic in compliance with the legal provisions in force.

Your personal data provided in the registration form (name, e-mail address) will be managed separately from any reports you may have; any association of your identity with the report may be carried out exclusively by the "Manager" responsible for managing the reports, in the cases and within the terms contemplated by the legislation.

Your personal data will be retained for a period of time related to compliance with the reporting management procedure and the fulfillment of legal obligations, normally for a period of 10 years.

 

RIGHTS OF THE INTERESTED PARTY (ARTICLES 12-23 OF THE REGULATION)

At any time it is possible to know what data is being processed by the Data Controller(s), if the legal requirements are met, to have it updated, integrated, rectified or deleted, to receive a copy in a structured format, to request its blocking and to object at any time to their processing in accordance with the methods established by the EU Regulation and to receive timely feedback in this regard. When the conditions are met, it is possible to contact the Guarantor Authority for the protection of personal data.
